Probate Process Overview
The Probate Process is broken down into 10 steps that will be carried out by the Executor or Administrator of the Estate.
This may give you, your family, and other interested parties information. Speak with the attorney that drew the will and other professionals that are familiar with the financial affairs.
Look into the insurance and protection of real estate and personal property. Secure knowledge of ongoing business interests and examine all books and files.
Obtain proof of heirship, petition for the probate of the Will, and apply for any necessary court orders in administration of the estate.
Collect all complex and liquid assets. Inventory, appraise, and arrange for the management and supervision of all assets; inclduing household goods, ongoing business, and real estate.
Gather complete and satisfactory evidence of the value of the personal and real property.
Govern by the wishes expressed in the Will, the requirements of the state in which the deceased resided, and the requirements of the local probate law.
Review Income Taxes, file returns, and pay any necessary taxes.
Arrange for the proceedings to release securities of property located in other states.
Publish notice to creditors, obtain all available evidence regarding propriety of each claim filed, resist all improper claims, and pay all approved and allowed claims from the estate funds.
Prepare data for the financial account. Notify interested persons of hearing on account after the court has settlled and distribute remaining assets as directed by the court.
After the final payment and distribution to legatees and devisees, secure final discharge as an executor.
